1. Introduction and Acceptance
These Terms and Conditions ("Terms") govern your use of the facilities, memberships, bookings, and services offered by TLN61, operating as TLN61 ("Club", "we", "us"), including when accessed or booked through the SportyPlus platform ("Platform"). By creating an account, purchasing a membership, or making a reservation with the Club, you ("Member", "User", "you") agree to be bound by these Terms. If you do not agree, please do not use our services.
2. About the Club and the Platform
- TLN61 is the operator of the sports facility located at Tallinna 61, Kuressaare, Estonia 93815, Estonia .
- SportyPlus is a third-party software platform that provides the Club with online booking, membership management, and payment-processing tools. SportyPlus is not the operator of the facility and is not a party to the membership or booking agreement between you and the Club; it acts solely as the Club's technology and payment-processing provider.
- The Club is the data controller for personal data collected through the Platform in connection with your membership and bookings, unless stated otherwise in the Club's Privacy Policy.
3. Definitions
- Membership — a paid or free arrangement granting a Member access to the Club's facilities and services for a defined period, under a specific membership plan.
- Reservation / Booking — a confirmed allocation of a court, facility, class, or service to a Member for a specific date and time.
- Facilities — courts, equipment, changing rooms, and any other spaces or assets made available by the Club.
4. Account Registration and Eligibility
4.1 To book facilities or purchase a membership, you must register an account on the Platform and provide accurate, current, and complete information, including your name, email address, and phone number.
4.2 You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4.3 Members under 18 years of age require the consent and supervision of a parent or legal guardian, who must register the account and accepts these Terms on the minor's behalf.
4.4 The Club reserves the right to refuse, suspend, or terminate any account at its reasonable discretion, including for breach of these Terms or the Club's code of conduct.
5. Memberships
5.1 Membership plans, their duration, pricing, and included benefits (e.g. number of bookings, discounts, guest access) are described on the Platform at the time of purchase and form part of these Terms.
5.2 Membership fees are payable in advance, either in full or, where the Club offers this option, in installments.
5.3 Memberships automatically renew at the end of each term unless cancelled by the Member with reasonable prior notice, as described on the Club's membership page.
5.4 Membership fees are non-refundable except as required by applicable consumer protection law or as expressly stated by the Club in writing.
6. Bookings and Reservations
6.1 Reservations may be made through the Platform in advance, subject to availability and any limits set by your membership plan.
6.2 Cancellations. You may cancel or reschedule a booking free of charge up to the notice period shown for your membership plan on the Platform. Cancellations made after this window, or no-shows, may be subject to a cancellation fee or forfeit of the booking credit, as described on the Platform.
6.3 Weather-dependent facilities. If the Club's outdoor facilities are affected by weather conditions, the Club may cancel or reschedule affected bookings. Members will be notified through the Platform, and, where the Club's policy provides for it, affected bookings will be refunded or credited rather than charged as a cancellation.
6.4 The Club reserves the right to cancel or modify a booking due to maintenance, safety concerns, or events beyond its reasonable control, in which case it will use reasonable efforts to offer an alternative time or a credit.
7. Fees and Payment
7.1 All prices are displayed in the currency, and inclusive/exclusive of tax as indicated on the Platform at checkout.
7.2 Payments made through the Platform are processed via SportyPlus's designated payment processor. By providing payment details, you authorize the Club, through the Platform, to charge the applicable fees.
7.3 Invoices, where issued, will reflect the Club's legal and tax details: TLN61, Tallinna 61, Kuressaare, Estonia 93815.
7.4 The Club may change membership and booking prices for future terms or bookings by providing reasonable notice through the Platform; changes will not affect already-confirmed bookings or the current term of an active membership.
8. Facility Use and Code of Conduct
8.1 Members must comply with the Club's facility rules, posted signage, and staff instructions, including rules on appropriate footwear, attire, and equipment.
8.2 Members must treat staff, coaches, and other Members with respect. The Club reserves the right to remove any person from the premises, and to suspend or terminate their membership, for conduct that is abusive, unsafe, or disruptive.
8.3 Members are responsible for any damage they cause to the Club's Facilities or equipment through misuse or negligence.
9. Health, Safety, and Assumption of Risk
9.1 Participation in sports activities carries inherent risk of injury. By using the Club's Facilities, you confirm that you are physically fit to participate and do so at your own risk.
9.2 You must inform Club staff of any medical condition that may affect your ability to safely use the Facilities.
9.3 To the maximum extent permitted by applicable law, the Club is not liable for personal injury arising from the ordinary risks of sports participation, except where such injury results from the Club's gross negligence or willful misconduct.
10. Liability
10.1 The Club is not liable for loss or damage to personal belongings brought onto its premises, except where caused by the Club's negligence.
10.2 To the extent permitted by applicable law, the Club's total liability arising out of or in connection with these Terms is limited to the amount paid by the Member for the membership or booking giving rise to the claim, except for liability that cannot be limited or excluded under Estonia law (such as liability for death, personal injury, or fraud).
10.3 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable consumer protection law.
11. Suspension and Termination
11.1 The Club may suspend or terminate a Member's account and membership, immediately and without refund of already-elapsed periods, for material breach of these Terms, non-payment, or conduct endangering the safety of others.
11.2 A Member may cancel their membership at any time in accordance with the cancellation terms of their specific membership plan and applicable consumer protection law, including any statutory right of withdrawal.
12. Intellectual Property
All content on the Platform related to the Club — including its name, logo, and promotional materials — is the property of the Club or its licensors and may not be used without prior written consent.
13. Privacy and Data Protection
13.1 The Club processes your personal data in accordance with applicable data protection law, including the EU General Data Protection Regulation (GDPR), as described in the Club's Privacy Policy.
13.2 SportyPlus processes personal data on the Club's behalf, acting as a data processor, solely to provide the booking, membership, and payment functionality of the Platform.

14. Communications
By registering an account, you agree to receive service-related communications (booking confirmations, cancellations, membership notices) from the Club through the Platform, by email, or by SMS. You may opt out of marketing communications at any time while continuing to receive essential service communications.
15. Force Majeure
The Club is not liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including natural disasters, government action, utility failures, or technical outages of the Platform's third-party providers.
16. Changes to These Terms
The Club may update these Terms from time to time. Material changes will be communicated through the Platform or by email with reasonable prior notice. Continued use of the Club's services after changes take effect constitutes acceptance of the updated Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of Estonia, without regard to its conflict of law principles, and any disputes shall be subject to the exclusive jurisdiction of the competent courts of Estonia, except where mandatory consumer protection law provides otherwise.
